01 Acceptance of these terms

These Terms & Conditions ("Terms") govern your use of the websites operated by New Wave Jiu Jitsu ("we," "us," or "our"), including our adult and kids program landing pages, and your booking of a free trial class. By using the site or submitting your details, you agree to these Terms and to our Privacy Policy. If you are booking on behalf of a child, you confirm that you are the parent or legal guardian and that you accept these Terms for them.

02 The free trial class

We offer a complimentary first class so you can experience training before committing to anything. The free trial is for new students only and is offered at our discretion. Booking a time through our site reserves a spot in a scheduled class; it is not a membership, and there is no obligation to purchase anything afterward.

We do our best to honor every booked time, but classes and schedules can change. If we need to reschedule, we will contact you using the details you provided. Please arrive about ten minutes early so we can greet you and get you started; new-student class times include a short buffer for this.

03 Physical activity & assumption of risk

Brazilian Jiu-Jitsu is a physical, contact-based activity that carries an inherent risk of injury. By booking and attending a class, you acknowledge these risks and confirm that you, or the child you are enrolling, are in suitable health to participate. We recommend consulting a physician before beginning any new physical activity.

04 Communications consent

When you submit your phone number and email through our booking forms, you agree that we may contact you about your free trial and your interest in our classes by phone call, email, and text message, including through an automated scheduling system, at the number and address you provide. Consent to receive these messages is not a condition of purchasing anything, and message and data rates may apply.

You can opt out at any time by replying STOP to a text, using the unsubscribe link in an email, or contacting us at info@nwjj.net. We will still be able to reach you about a class you have already booked.

05 Acceptable use of the site

You agree to use the site only for lawful purposes and to provide accurate information when you book. You agree not to interfere with the site's operation, attempt to gain unauthorized access to any part of it, submit false or fraudulent bookings, or use the site in any way that could harm us or other visitors.

06 Intellectual property

All content on this site, including the New Wave Jiu Jitsu name, logo, text, photographs, graphics, and design, is owned by us or our licensors and is protected by intellectual property laws. You may view and share the pages, but you may not copy, reproduce, or use our content for commercial purposes without our written permission.

07 Third-party services & links

Our booking flow uses a third-party scheduling provider, and our site uses advertising and analytics services from Meta and Google, as described in our Privacy Policy. These services are governed by their own terms and privacy policies, and we are not responsible for their content or practices. Any links to other websites are provided for convenience only.

08 Disclaimers

The site and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components, or that any information on it is complete or current.

09 Limitation of liability

To the fullest extent permitted by law, New Wave Jiu Jitsu and its owners, instructors, and staff will not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the site or your reliance on its content. This section does not limit any liability that cannot be excluded under applicable law, and nothing here affects the separate waiver and release you sign before training.

10 Indemnification

You agree to indemnify and hold harmless New Wave Jiu Jitsu and its owners, instructors, and staff from any claims, damages, or expenses, including reasonable legal fees, arising from your misuse of the site, your violation of these Terms, or your violation of any law or the rights of a third party.

11 Governing law

These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-law rules. Any dispute relating to the site or these Terms will be handled in the state or federal courts located in Marion County, Indiana, and you agree to that jurisdiction. We may update these Terms from time to time; the "last updated" date above reflects the current version, and continued use of the site means you accept any changes.
